Tosoh Asia Pte. Ltd. (“Tosoh” or “we”) considers the privacy of individuals a priority and we strive to protect personal data in our possession or under our control against unauthorized disclosure or use. Please see below for our Privacy Statement.
1. Introduction
1.1. This statement sets out our privacy policy and the practices that will be followed with respect to the collection, use, disclosure and/or otherwise processing of personal data. This statement is provided in accordance with the Personal Data Protection Act (Act 26 of 2012) (the “PDPA”).
2. Definition
2.1. As used in this Privacy Statement:
2.1.1 “person” means an individual who has (a) submitted a job or internship application with us, or (b) contacted us through any means for any other purposes; and
2.1.2 “personal data” means data, whether true or not, about an individual who can be identified: (a) from that data, or (b) from that data and other information to which Tosoh has or is likely to have access; but excludes (c) business contact information.
2.2. Depending on the nature of your interaction with us, some examples of personal data which we may collect from you include your name, contact information such as your address, email address or telephone number, photographs and other audio-visual information, employment information, education background, and information about your usage of and interaction with our website.
2.3. Other terms used in this Privacy Statement shall have the meanings given to them in the PDPA (where the context so permits).
3. Collection, Use and Disclosure of Personal Data
3.1. Tosoh generally collects personal data from our customers, business partners, contractors, employees and other individuals such as job applicants. We would only collect personal data that has been provided to us voluntarily by you or via a third party who has been duly authorised by you to disclose your personal data to us (your “authorised representative”).
3.2. These personal data may be furnished to us in forms filled by you, face to face meetings, emails or telephone conversations. We may also keep a record of any contact you have with us. These data would be collected only for business purpose or for the purpose(s) stated by us when we gather the personal data from you.
3.3. The personal data collected may be used for any or all of the following purposes:
3.3.1 to provide our products as part of our business operations;
3.3.2 for internship / employment application and recruitment purposes;
3.3.3 for follow-up action regarding any complaint, feedback, query or request received;
3.3.4 to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority
3.3.5 for any other purposes for which you have provided the personal data; and
3.3.6 for any other incidental business purposes.
3.4. Tosoh may disclose your personal data:
3.4.1 with your consent, where such disclosure is required for performing obligations in the course of or in connection with our provision of the products requested by you;
3.4.2 to comply with any applicable laws, regulations, codes of practice, guidelines or rules; or
3.4.3 to third party service providers, agents and other organisations we have engaged to perform any of the functions listed in Paragraph 3.3 above for us. Any third party engaged by us will be contractually bound to keep all personal data confidential.
3.5. The purposes listed in Paragraph 3.3 may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period necessary for our business or legal purposes).
4. Withdrawal of Consent
4.1. The consent that you provide for the collection, use and disclosure of your personal data will remain valid until such time it is withdrawn by you in writing. You may withdraw your consent and request us to stop using and/or disclosing your personal data for any or all of the purposes listed above by submitting your request to our Data Protection Officer.
4.2. Depending on the complexity of the request and its impact to our relationship with you, Tosoh will cease (and instruct any of our data intermediaries and agents to cease) collecting, using or disclosing the personal data within a reasonable timeframe of receiving your request in writing, unless required or authorised under applicable laws.
5. Access to and Correction of Personal Data
5.1. You are entitled to have access to the personal data about you that is in our possession or under our control and information about the ways in which the personal data has been or may have been used or disclosed within a year before the date of the request. This can be done by you making a written application to our Data Protection Officer requesting for such information. Upon request and within a reasonable timeframe of receiving your request in writing, Tosoh will provide you with the requested information. Tosoh reserves the right to charge a fee (representing our costs in administering your request) for supplying such information.
5.2. Tosoh will also, where you have requested that we correct an error or omission in the personal data about you that is under our possession or control, correct such data as soon as practicable and send the correct personal data to every organisation to which the personal data was sent within a year before your request was made.
6. Transfer of Personal Data Outside Singapore
6.1. Unless for business-related needs, Tosoh generally does not transfer your personal data outside of Singapore. However, if we do so, we will ensure that the recipients provide a standard of protection to your personal data that is comparable to that provided under the PDPA.
7. Accuracy and Protection of Personal Data
7.1. Tosoh will take reasonable steps to make sure that personal data collected by us or on our behalf is accurate, complete and up to date.
7.2. To safeguard personal data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, Tosoh has introduced appropriate administrative, physical and technical measures to protect personal data in our possession and/or under our control.
7.3. While no method of protection is completely secure and security cannot be guaranteed, we will do our best to maintain the privacy of personal data in our possession and/or under our control.
8. Retention of Personal Data
8.1. Tosoh will not keep personal data for longer than is necessary to fulfil the purpose(s) for which it was collected unless consent is withdrawn by you, or as required or permitted by the PDPA. Thereafter, we will destroy or permanently de-identify the personal data.
9. Use of Cookies and Pixel Tags
9.1. We, like many other corporate websites, use “cookies” and other technologies in our website. These technologies allow us to better understand which parts of our website are the most popular and how much time our visitors spend on different parts. These technologies also allow us to better understand traffic patterns on our website, to customize your experience and provide you with more convenience each time you visit our website.
9.2. However, if you do not wish to receive cookies, you can set the security options in your web browser to disable them. Although you must understand that certain features of our website will become unavailable to you once you disable cookies.
9.3. Our website also collects certain information automatically and stores them in log files. Most other websites do this. The information collected includes internet protocol (“IP”) addresses, browser type, internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp and clickstream data.
9.4. Such information on its own does not generally reveal who the individual visitors are and we do not use this information to market to visitors. This information allows us to analyze trends, administer our website, track visitors’ movements on our website and gather demographics about visitors.
9.5. Tosoh also may use pixel tags. Pixel tags would enable us to send email messages in a format visitors can read and tell us whether emails have been opened. Pixel tags also would tell us what parts of our website visitors have visited. They also would allow us to gauge the effectiveness of searches visitors perform on our website.

11. Changes
11.1. From time to time we may elect to modify or update our privacy policy. We do not always modify this Privacy Statement to reflect those changes. However, if there is a material change, we will modify this Privacy Statement and post it on our website. You will not receive a notice or announcement of any modification to this Privacy Statement. Your continued contact with us constitutes your acknowledgement and acceptance of such changes.
